Eric Zimbelman is a partner of Peel Law Group and has been practicing complex construction, business, commercial and real estate litigation for nearly thirty years. Originally from Myrtle Pointe, Oregon, Eric received a B.A and M.A from the University of ORegon and his J.D. from the Seattle University School of Law where he was honored to graduate as cum laude.
Eric’s multi-jurisdictional practice concentrates on private and public contracting, mechanic’s liens, real estate, trusts and estates, employment, business and commercial litigation. He has successfully represented his clients in numerous bench trials, jury trials, and arbitrations with respect to multimillion dollar claims, and is a frequent speaker on construction, real estate, and litigation topics. - Construction Litigation
- Successfully appealed and argued to the Nevada Supreme Court for an underground contractor in Byrd Underground v. Angaur, 332 P.3d 273 (2014) that established new precedent for the commencement and priority of contractor liens
- Recently obtained recovery of more than $1.3 million for general contractor while defeating more than $2 million in defective work counterclaims in North Dakota arbitration
- Recently obtained recovery of more than $5 million for steel erection and fabricating contractors at the Crescent Dunes solar energy facility in Tonopah, Nevada
- Successfully drafted arguments made to the Nevada Supreme Court for the landmark decision in In re Fontainebleau Las Vegas Holdings, 289 P.3d 1199 (2012) that protects lien claimants against priority leapfrogging by lenders
- Business Litigation
- Successfully contested action to dissolve limited liability company in Nevada and obtained dismissal of related business tort action in Indiana
- Obtained summary dismissal of federal securities fraud claims. Published decision – Dobyns v. Trauter, 552 F.Supp.2d 1150 (2008 USDC WDWA)
- Acted as Lead Counsel in a six week jury trial defending high profile individual and company against multi-million dollar claims of fraud, conspiracy and RICO violations and won the defense verdict.
- Received Arbitration award and dismissal of claims against Seattle-area attorneys sued by former business partner. Six figure award and judgment for corporate indemnification, attorney’s fees and expenses. Related bankruptcy litigation and successful appellate defense in Bankruptcy Appellate Panel and Ninth Circuit Court of Appeals.
- Real Estate
- Obtained injunction restraining foreclosure by bank against commercial buildings in Las Vegas, Nevada
- Obtained injunction restraining foreclosure by bank against commercial property in Kitsap County, Washington
- Successfully defended and settled lawsuit seeking recovery of realtor commissions
- Intellectual Property
- Successfully defended an independent ink cartridge manufacturer against patent infringement claims by Xerox
- Defended trademark registration challenge against local map maker by Time Warner
- Received a favorable settlement in copyright infringement action for map maker against local governmental jurisdiction
